My, koalicja ponad 244 organizacji działających na rzecz praw dzieci i przeciwdziałania przemocy seksualnej, zdecydowanie potępiamy fakt, że decydenci UE nie przedłużyli podstawy prawnej umożliwiającej prowadzenie tych działań wykrywczych.
To zaniechanie tworzy niezwykle niepokojącą i nieodpowiedzialną lukę w ochronie dzieci. Konsekwencje będą katastrofalne zarówno w Europie, jak i poza nią. Aby przeciwdziałać milionom zdjęć i nagrań przedstawiających seksualne wykorzystywanie dzieci krążących w sieci, wykrywanie na dużą skalę jest niezbędne i stanowi fundament działań. Umożliwia ono platformom zgłaszanie przypadków nadużyć organom ścigania, co uruchamia dochodzenia prowadzące do identyfikacji ofiar i pociągania sprawców do odpowiedzialności. Pozwala także firmom technologicznym usuwać nielegalne materiały i zapobiegać ich dalszemu rozpowszechnianiu. Dzięki tym działaniom identyfikowane są tysiące ofiar, a miliony nielegalnych plików są usuwane z obiegu.
Bez mechanizmów wykrywania liczba zgłoszeń dotyczących materiałów przedstawiających seksualne wykorzystywanie dzieci gwałtownie spadnie, co już miało miejsce podczas wcześniejszej luki prawnej w 2021 roku. Organy ścigania utracą kluczowe tropy umożliwiające wykrywanie przypadków przemocy seksualnej, a dzieci pozostaną uwięzione w sytuacjach nadużyć. Tymczasem nielegalne treści będą nadal rozpowszechniane bez kontroli, zmuszając ofiary do ponownego przeżywania traumy za każdym razem, gdy materiał jest oglądany lub udostępniany. Za każdym zdjęciem i nagraniem stoi dziecko, zmuszane do wielokrotnego naruszania jego podstawowych praw, w tym prawa do prywatności.
Ochrona dzieci nie jest opcjonalna to obowiązek wynikający z ram prawnych UE i prawa międzynarodowego, którego nie można uniknąć. W kolejnych badaniach opinii publicznej obywatele UE konsekwentnie popierali środki wykrywania przez ostatnie 5 lat. Europejscy przywódcy muszą odpowiedzieć na ten mandat. Dzieci nie mogą nadal płacić ceny politycznego impasu.
Wzywamy decydentów UE do pilnego i odpowiedzialnego działania poprzez przyjęcie bez dalszej zwłoki ambitnych i trwałych ram prawnych. Każdy dzień bez wykrywania to kolejny dzień, w którym dzieci pozostają bez ochrony. Unia Europejska musi działać teraz, aby zamknąć tę lukę, zapewnić skuteczne wykrywanie i wypełnić swój obowiązek ochrony dzieci.
